zetoc and zetoc alert Terms and Conditions of Use

zetoc is based on data provided free of charge to the UK HE and FE community by the British Library. The data is loaded into a database mounted at MIMAS at the University of Manchester. The funding to supply the service is provided by the JISC. zetoc data is used to provide zetoc alerts.

When you access zetoc and/or receive zetoc alerts you agree to the terms and conditions detailed below.


1. For the purpose of interpreting this document, the following definitions shall apply:

(a) "zetoc" is an on-line information retrieval and document supply service operated by MIMAS on behalf of JISC and the British Library;
(b) "zetoc alerts" is an on-line current awareness service operated by MIMAS on behalf of JISC and the British Library;
(c) "Database" is a collection of data held by MIMAS in machine-readable format.
(d) "Data" is the records that make up the "Database". The Data is the copyrighted material of the contributing publishers;
(e) "MIMAS" is Manchester Information and Associated Services operated by Manchester Computing at the University of Manchester;
(f) "JISC" is the Joint Information Systems Committee and is a strategic advisory committee working on behalf of the funding bodies for higher and further education (HE and FE) in England, Scotland, Wales and Northern Ireland; and
(g) "Unauthorised Person" is anybody who is not studying or not a member of staff at your institution.


2.1 The British Library grants you a non-transferable, non-exclusive licence to access the Database, download Data and receive zetoc alerts. The licence is personal to you and the grant does not include the right to grant sub-licences.

2.2 You shall use the Data and the information available or obtained from the Data solely for the purposes of learning and teaching, academic research or private study.

2.3 You may print out, save and distribute the Data (which can include using the Data to compile a separate internal database) within your institution and to registered members of your institution but your attention is drawn specifically to Clauses 8.1 and 8.2 of these Terms and Conditions.

2.4 Other than with the prior written consent of the British Library, you are expressly prohibited from using the Database or redistributing the Data for the purposes of:

2.4.1 reproducing, retransmitting, distributing, disseminating, selling, publishing, broadcasting or circulating the Data for any commercial purpose by any means whatsoever.
2.4.2 permitting the infringement or otherwise prejudicing the proprietary rights of the British Library or individual publishers contributing to the Data.
2.4.3 allowing access to the Data to any Unauthorised Person.

2.5 You acknowledge that the use of the Data requires you to use your own skill and judgement and you accept that neither the British Library, MIMAS, nor the JISC shall have any liability in respect of any third party claims.

2.6 You shall ensure that your equipment and/or software used to access the Database shall not corrupt the Database or the Data.

2.7 You shall not:

2.7.1 make any additions, deletions, modifications, adjustments or alterations to the Database.
2.7.2 attempt to rectify or permit any persons other than the British Library, MIMAS or their agents to rectify any fault or inaccuracy in the Database.
2.7.3 use any equipment and/or software in a manner that is inconsistent with these terms and conditions.
2.7.4 permit equipment or software to be linked to or communicate in any manner with or be used in connection with any other database, whereby the information, material or Data obtained from the Database or any part of it is being accessed, used, stored or distributed as the case may be, by or through such other database or equipment or software.


3.1 The British Library and/or the JISC may make additions to or deletions from the Database and modify or otherwise change zetoc and zetoc alerts (including features) without notice. In addition the British Library and/or the JISC may change any and all service rates, schedules, document supply prices and other prices or other administrative or operational procedures of the service at any time. All such changes shall be effective immediately when published by the British Library. The British Library will whenever possible give advanced notice of any change.


4.1 Subject to clause 4.2 and a service level agreement (SLA) between MIMAS and the JISC Monitoring and Advisory Unit (MAU), access to zetoc should be available 24 hours per day 7 days per week. The SLA requires that MIMAS service machines and communications facilities will be available for 99.0% of scheduled uptime and scheduled downtime of less than 10.4 hours per year. 4.2 The British Library and/or MIMAS shall notify the days or periods during which zetoc or any Database shall not be available for access. Such notification shall be given via the zetoc service message or by such other means as the British Library or MIMAS may determine.

4.3 You are responsible for making the necessary arrangements for access to zetoc and for ensuring that all requirements, legal and technical, are complied with. The British Library and/or MIMAS may provide such assistance as it considers reasonable where difficulties are encountered.

4.4 The journals available for zetoc alerts are subject to the continuity of their publication. The British Library is not liable for the provision of zetoc alerts for any title that might cease publication. The British Library will supply Data to MIMAS, and MIMAS will forward it, as soon as possible after the journal/s have been received by the British Library.


5.1 The British Library will make all reasonable efforts to ensure that the information provided is free of errors and up to date, but it makes no guarantees as to the accuracy of that information or its fitness for any purpose whatever.

5.2 Neither the British Library nor MIMAS nor JISC shall be liable in contract, tort or otherwise for any direct, indirect or consequential loss or damage sustained by you or others directly or indirectly making use of the Data, zetoc and zetoc alerts including but not limited to any loss or damage resulting as a consequence of any defects, delays, interruptions or failures in zetoc and/or zetoc alerts or inaccuracies or errors in the Data and specifically excludes liability for the same to the extent permitted by law.


6.1 You undertake to indemnify and keep indemnified at all times the British Library, MIMAS and the JISC against all actions, proceedings, costs, claims, demands, liabilities and expenses whatsoever (including legal and other fees and disbursements) sustained, incurred or paid by the British Library, MIMAS or the JISC directly or indirectly in respect of any breach by you of any of these terms and conditions.


7.1 The British Library, MIMAS or the JISC may suspend your access to zetoc and cease to supply zetoc alerts without prior notice if you have broken any of the terms and conditions of use.


8.1 All rights in the Database are and will remain the property of the British Library Board. Any rights that subsist in components of the Database remain the property either of the British Library Board or individual publishers contributing to the Database. All rights reserved.

8.2 Your use of the Data shall be restricted solely to the purposes as set out in Clauses 2.2 and 2.3 of these Terms and Conditions. You shall not now, or at any time in the future, without the prior written consent of the British Library, abuse or permit the abuse of the rights as set out in Clause 8.1. In addition you shall not use or adopt any trade mark, trade name, logo or commercial designation that includes or is similar to or may be mistaken for the whole or any part of any trade mark, trade name or commercial designation used by the British Library, MIMAS or the JISC without their prior written consent.

zetoc ordering Terms and Conditions for Document Supply

Any documents supplied by the British Library through the zetoc orders service are supplied under the following terms and conditions:


You are eligible to use this service while you are a member of a UK further and higher education institution sponsored by the Joint Information Systems Committee (JISC), or a member of an officially licenced institution.


You undertake:

(a) that any item delivered by any electronic method (including facsimile transmission) will not be electronically stored, displayed on screen, processed, manipulated or retransmitted other than to enable a single copy on paper printed out by or for the individual requesting the item.

(b) that all electronic versions of the item are destroyed after successful printing.


3.1 You shall pay the charges as specified in the current price lists for document supply (which may be changed from time to time).

3.2 All documents will be paid for by credit/debit card. Confirmation of payment will be displayed for the appropriate request on your Completed Orders screen. A receipt will also be sent by mail.

3.3 Payments shall be made in such currency as the parties shall agree. Where applicable Value Added Tax (or the local equivalent) at the appropriate rate will be charged and will be payable by you.


4.1 The British Library will make all reasonable efforts to ensure that the information provided is free of errors, but it makes no guarantees as to the accuracy of that information or its fitness for any purpose whatsoever.

4.2 You are responsible for any debt incurred ordering documents using zetoc orders.
