Zetoc is a service that provides access to the British Library’s electronic table of contents of journals and conference proceedings from 1993 to date. Zetoc and Zetoc alert are provided free of charge to the UK HE and FE community (and other organisations by specific agreement) by the British Library in co-operation with the UK funding bodies and Jisc. Zetoc data is used to provide Zetoc alerts.
Access to Zetoc and/or Zetoc alerts is offered on the basis that you agree to be bound by the following Terms and Conditions. The offer is non-negotiable. By accessing Zetoc or by accepting Zetoc alerts you agree to accept the following Terms and Conditions and are bound by them without variation.
NOTE: In August 2014 Mimas was transferred to Jisc.
1. For the purpose of interpreting this document, the following definitions
shall apply:
(a) "Zetoc" is an on-line information retrieval and document ordering
service operated by Mimas on behalf of the UK funding bodies and the British
Library;
(b) "Zetoc alerts" is an on-line current awareness service operated
by Mimas on behalf of the UK funding bodies and the British Library;
(c) "Database" is a collection of Records held by Mimas in machine-readable
format.
(d) "Mimas" is based at the University of Manchester;
(e) "Jisc" is the Joint Information Systems Committee and is a strategic
advisory committee working on behalf of the UK funding bodies for higher and
further education (HE and FE) in England, Scotland, Wales and Northern Ireland;
(f) "Record" means, as appropriate, the complete machine-readable
bibliographic description of an article or a paper in the Database;and
(g) "Unauthorised Person" is anybody who is not studying or not a
member of staff at your institution.
2.1 The British Library grants you a non-transferable, non-exclusive licence to access the Database and use the Records in accordance with these Terms and Conditions as set out herein and receive Zetoc alerts. The licence is personal to you and the grant does not include the right to grant sub-licences.
2.2 You shall use the Records and the information available or obtained from the Records solely for the purposes of education, teaching, distant learning, private study and/or research.
2.3 You may print out, save and share the Records (which can include using the Records to compile a separate internal database) within your institution and to registered members of your institution but your attention is drawn specifically to Clause 3 and Clauses 9.1 and 9.2 of these Terms and Conditions.
2.4 You acknowledge that the use of the Records requires you to use your own skill and judgement and you accept that neither the British Library, Mimas, the UK funding bodies nor Jisc shall have any liability in respect of any third party claims.
2.5 You shall ensure that your equipment and/or software used to access the Database shall not corrupt the Database or the Records.
3.1 Your use of Zetoc and Zetoc alerts is solely permitted for the purposes set out in Clause 2 of these Terms and Conditions. You are prohibited from:
3.1.1 making any additions, deletions, modifications, adjustments or alterations
to the Database.
3.1.2 attempting to rectify or permit any persons other than the British Library,
Mimas or their agents to rectify any fault or inaccuracy in the Database.
3.1.3 infringe or permit the infringement or otherwise prejudice the proprietary
rights of the British Library or individual publishers contributing to the Database.
3.1.4 using any equipment and/or software in a manner that is inconsistent with
these Terms and Conditions.
3.1.5 permitting equipment or software to be linked to or communicate in any
manner with or be used in connection with any other database, whereby the information,
material or Records obtained from the Database or any part of it is being accessed,
used, stored or distributed as the case may be, by or through such other database
or equipment or software.
3.1.6 allowing access to the Records to any Unauthorised Person.
3.1.7 other than with the prior written consent of the British Library, reproducing,
retransmitting, distributing, disseminating, selling, publishing, broadcasting
or using the Records for any monetary reward by any means whatsoever.
4.1 The British Library and/or Jisc may make additions to or deletions from the Database and modify or otherwise change Zetoc and Zetoc alerts (including features) without notice. In addition, the British Library and/or the UK funding bodies may change any and all service rates, schedules and other prices or other administrative or operational procedures of the service at any time. The British Library will whenever possible give advance notice of any change.
5.1 Subject to Clause 5.2 and a service level agreement (SLA) between Mimas
and the Jisc Monitoring Unit, access to Zetoc should be available 24 hours per
day 7 days per week. The SLA requires that Mimas service machines and communications
facilities will be available for 99.0% of scheduled uptime and scheduled downtime
of less than 10.4 hours per year. (Scheduled downtime is planned downtime for
which the user community has received at least 10 working days warning. For

5.2 The British Library and/or Mimas shall notify the days or periods during
which Zetoc or any Database shall not be available for access. Such notification
shall be given via the Zetoc service message or by such other means as the British
Library or Mimas may determine.
5.3 You are responsible for making the necessary arrangements for access to
Zetoc and for ensuring that all requirements, legal and technical, are complied
with. The British Library and/or Mimas may provide such assistance as it considers
reasonable where difficulties are encountered.
5.4 The journals available for Zetoc alerts are subject to the continuity of
their publication. The British Library is not liable for the provision of Zetoc
alerts for any title that might cease publication. The British Library will
supply Records to Mimas, and Mimas will forward it, as soon as possible after
the journal/s have been received by the British Library.
6.1 The British Library will make all reasonable efforts to ensure that the
information provided is free of errors and up to date, but it makes no guarantees
as to the accuracy of that information or its fitness for any purpose whatever.
6.2 Neither the British Library, the UK funding bodies, Mimas nor Jisc shall
be liable in contract, tort or otherwise for any direct, indirect or consequential
loss or damage sustained by you or others directly or indirectly making use
of the Records, Zetoc and Zetoc alerts including but not limited to any loss
or damage resulting as a consequence of any defects, delays, interruptions or
failures in Zetoc and/or Zetoc alerts or inaccuracies or errors in the Records
and specifically excludes liability for the same to the extent permitted by
law.
7.1 You undertake to indemnify and keep indemnified at all times the British Library, the UK funding bodies, Mimas and Jisc against all actions, proceedings, costs, claims, demands, liabilities and expenses whatsoever (including legal and other fees and disbursements) sustained, incurred or paid by the British Library, the UK funding bodies, Mimas or Jisc directly or indirectly in respect of any breach by you of any of these terms and conditions.
8.1 The British Library, Mimas or Jisc may suspend your access to Zetoc and cease to supply Zetoc alerts without prior notice if you have broken any of these Terms and Conditions.
9.1 All rights in the Database are and will remain the property of the British
Library Board. Any rights that subsist in the Records remain the property either
of the British Library Board or individual publishers contributing to the Database.

9.2 Your use of the Records shall be restricted solely to the purposes as set
out in Clauses 2.2 and 2.3 of these Terms and Conditions. You shall not now,
or at any time in the future, without the prior written consent of the British
Library, abuse or permit the abuse of the rights as set out in Clause 9.1. In
addition you shall not use or adopt any trade mark, trade name, logo or commercial
designation that includes or is similar to or may be mistaken for the whole
or any part of any trade mark, trade name or commercial designation used by
the British Library, the UK funding bodies, Mimas or Jisc without their
prior written consent.
